Failed 12th Avenue Subdivision cleanup to begin soon
The City hopes to start cleanup soon on the 12th Avenue subdivision, following a lengthy legal process.
A subdivision development on 12th Avenue was originally initiated in 2015, however, was later abandoned.
The developer’s securities totalling almost $480,000 were forfeited to the City.
“Due to the incomplete work under the Development Agreement, in 2023 the City issued a Notice of Default and drew upon the securities. The securities can only be used for the purpose of completing work within the scope of the outstanding construction and deficiencies,” City notes state from the Tuesday, Sept. 10 council meeting.
The total cost of cleanup is estimated at just under $1.18 million.
Council voted to amend the capital budget to fund $420,430 for the 12th Avenue Subdivision Cleanup from restricted funds associated with the securities.
CAO Kevin Nagoya said some work could be done this year, but not all will get completed.
“We’re going to go in there and clean it up, finish the sidewalks and the roads and stuff like that, but it’s not a public roadway because there’s no subdivision that was ever registered for the property,” Nagoya said during the meeting.
“And then we’re trying to work through those items to see what opportunities there are. But at least we can get some of that work done and clean up the work that has been left there to the greatest extent possible.”
The property is currently listed for sale through Civil Enforcement, notes state.
